1. Acceptance of Terms

By downloading, accessing, or using Simit Messenger ("Simit", the "app", the "service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

2. Description of Service

Simit is a phone-number-based messaging application that lets you send text messages, photos and other content to your contacts, either in one-on-one or group conversations, over a secure (TLS-encrypted) connection. Simit's servers act as a relay: messages are deleted from our servers once delivered, and conversation history is stored only on users' devices. Simit uses a mutual-contacts model: you can exchange direct messages only with people who also have you in their contacts.

3. Eligibility & Accounts

  • You must be at least 13 years old (or the minimum legal age in your country) to use Simit.
  • You register using a valid phone number that you control, verified via a one-time SMS code.
  • You are responsible for the activity that occurs under your account and for keeping access to your device and number secure.
  • If you set a Registration Lock PIN, you are responsible for remembering it and keeping it confidential. We cannot recover or reset it for you. If you forget it, you can register again only after 7 days of inactivity on your account.

4. Pricing & Subscription

  • The first year of Simit, starting from the day you create your account, is free. Nothing is charged during that year.
  • After the free year, Simit is offered as a yearly subscription, currently US$0.99 per year. Prices in your local App Store currency may vary.
  • The subscription will be offered and billed through Apple's App Store, under Apple's payment and subscription terms. We will notify you in the app before any charge is made.
  • We may change the subscription price in the future. We will give you notice in advance of any price change.

5. Your Responsibilities

  • Use Simit only for lawful purposes and in compliance with these Terms.
  • Do not use the service to send spam, unsolicited bulk messages, or to harass others.
  • Respect the privacy and rights of the people you communicate with.
  • Do not attempt to disrupt, reverse-engineer, or gain unauthorized access to the service or its infrastructure.

6. Prohibited Content & Conduct

You may not use Simit to create, upload, or share content that is:

  • Illegal, harmful, threatening, or that incites violence;
  • Harassing, abusive, hateful, or discriminatory;
  • Sexually exploitative of minors in any way;
  • Spam, fraudulent, deceptive, or malicious (including malware);
  • Infringing on intellectual property or privacy rights of others.
Zero tolerance. Simit has no tolerance for objectionable content or abusive users. You can block any user and report users, messages or groups from within the app. When you report, your device sends us the reported message and up to 10 messages before it so we can review them. We review reports promptly and, where content or conduct violates these Terms, we remove the content and suspend or terminate the offending account. You can also report abuse to [email protected].

7. Privacy

Your use of Simit is also governed by our Privacy Policy, which explains what data we collect and how we use it. Please note that Simit encrypts data in transit but is not end-to-end encrypted.

8. Your Content

You retain ownership of the content you send through Simit. You grant us the limited rights necessary to temporarily store, transmit, and deliver your content to your intended recipients, to review content you or others report, and to operate the service. You are solely responsible for the content you share and represent that you have the rights to share it.

No message history on our servers. Simit does not store your message history. Messages and photos are deleted from our servers after delivery, and your conversations exist only on your devices. We cannot restore messages that are lost if you lose, replace or reset your phone, sign out, or delete the app. You are responsible for your own device backups, for example by turning on "Include messages in iPhone backup" in the app.

9. Intellectual Property

The Simit app, its name, logo, design, and software are owned by Simit Technologies and protected by intellectual-property laws. These Terms do not grant you any right to use our trademarks or branding without prior written permission.

10. Termination

You may stop using Simit and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms, misuse the service, or where required by law. Upon termination, your right to use the service ends immediately.

11. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Simit Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the service.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Continued use of Simit after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by applicable law in the jurisdiction in which Simit Technologies operates, without regard to conflict-of-laws principles. Nothing in these Terms limits any rights you may have as a consumer under mandatory local law.
